Scotgen has said it will appeal against a move to revoke the operating licence for its Dumfries plant, the BBC has reported.
Last month, the Scottish Environment Protection Agency (SEPA) took the action against the energy-from-waste facility. It said there were a range of operational issues including the consistent non-compliance with permit requirements, as well as a failure to comply with an enforcement notice.
A Sepa spokesman however has confirmed that the company had appealed to ministers over the licence.
He added: "This means that the revocation notice will be in abeyance until final determination or withdrawal of the appeal.
"We await information from the Scottish ministers as to the format, time and venue of the appeal."
