Scottish Ministers have overturned a decision by West Lothian Council to refuse planning permission for a new housing development in Mid Calder, paving the way for the construction of 125 new homes on New Calder Mill Road.

In February 2022, West Lothian Council's Planning Committee rejected the application from Robertson Homes, citing ten breaches of planning policy. The proposed development site, identified as an open space and countryside area not designated for housing, was a key reason for the refusal.

Following the rejection, Robertson Homes lodged an appeal with the Scottish Ministers. The appeal process included a detailed review conducted by a government-appointed reporter, who assessed the case before recommending the reversal of the council’s decision.

The Ministers' ruling permits the development to proceed, despite objections grounded in local planning policy. The decision has sparked debate over the balance between housing needs and the preservation of open and rural spaces in West Lothian.

The reporter has now granted permission for the development against the recommendation of West Lothian Council's planning officers and the formal refusal decision of the council stating: "I therefore conclude that while the proposed development does not accord overall with the relevant provisions of the development plan, granting planning permission is still justified."
