Construction union UCATT has won a legal protective ward claim on behalf of some of its members.
The members worked at WH Brown Construction in Dundee. In the autumn of 2012, the company went into administration with the loss of around 150 jobs.
UCATT pursued the claim that the company had failed in its duty to comply with Section 188 of the Trade Union and Labour Relations (Consolidation) Act 1992, by not consulting with recognised elected representatives of the workforce during a redundancy situation.
The union easily satisfied the tribunal that its 128 members should have been duly consulted through their union.
The affected workers will now receive in the region of £2,500 each due to the company's failure to consult.
Harry Frew, Regional Secretary of UCATT, said: "While this award cannot compensate for the loss of workers jobs, our members will welcome the money UCATT has secured for them through the pursuit of a protective award claim.
"Construction employers should be in no doubt that if they fail to properly consult with recognised representatives of the workforce, UCATT will seek to gain compensation through the protective award claim. This award also demonstrates the value of being a member of the trade union in the workplace."
WH Brown Construction was a long established company based in Dundee which specialised in house building as well as health and education projects.
